v10.0 – Legal & Intellectual Rights
We have to start off this article with another greeting, Happy Lunar New Year to our participants and community. May you all have a prosperous year and yes, this is a great year to startup! So.. Let’s Startup!
The #StartupLokal meetup v10.0 which held on 10th February 2010 at the Kompas Gramedia, Jalan Panjang, Jakarta discussed about Legal and Intellectual Rights. A pretty interesting topic for business owners in the online or even offline world that haven’t been really know the depth of this topic.

Right after that, Andy Laver Sirait presented iMulai(Indonesia Mulai or in English – Indonesia Starts). iMulai 3.0(which as its name told us, it’s the third iMulai) is an initiative by Microsoft and USAID to encourage entrepreneurship and innovation spirit in Indonesia.
On to the speakers, here’s some of the important notes of the night:
- Copyright is the owner’s right of an invention/product/creation and its copy.
- Copyright will be effective immediately once a product is made. Copyright doesn’t have to be registered first.
- The opposite of copyright is public domain. Public domain can be used whatever or however public want it to be.
- The difference between copyright and patent is that copyright protects creation while patent protects the idea.
- It is wrong for someone to make a creation based on a patented idea.
- Example of a patent is PageRank algorithm by Google.
- Trademark used by a Business to identify their product/service.
- Trademark comprise of the product/service’s name, logo, symbol, picture that accompany the product/service.
Socializing Intellectual Rights have been done together with the goverment and also Non-Goverment Organizations(NGO), but it doesn’t seem to work right now.
There’s some reasons to it. First, the concept of Intellectual Rights and the needs of it is not really being understand by people. Second, there isn’t a full support of Intellectual Rights enforcement from the owner and the government as the enforcer. Third, there’s no same perspective and understanding towards how important the protection and the enforcement of Intellectual Rights.
Intellectual Rights itself is one of the main issue that always been focused on by the developed countries when doing a partnership in business. Globalization is indeed identical with free market, free competition and transparency gave quite a big effect to Intellectual Rights enforcement in Indonesia. This situation is a challenge for Indonesia, where it has to give a decent protection to Intellectual Rights so there’s a healthy competition that will give us trust from foreign investors to invest here.
So, Intellectual Rights is an important thing to start a business or a startup or even a partnership. We all have to know and understand Intellectual Rights, for protecting what we have, and to get our rights of what we have produced and to evade any Intellectual Rights misuse.
